The arrest of Hawaiian home lands lessees in Pana'ewa and Keaukaha is appalling and absurd. They were within their constitutional and civil rights in their assertion that the county Department of Water Supply and Water Commission have no jurisdiction over matters that eoneem Hawaiian Home Lands. The Department of Hawaiian Home Lands governs its lands. It has the authority to derive revenue from the sale of water. The Admission Act of 1959 allows no state law to eneumber Hawaiian home lands unless Congress amends the HHCA. There have been no post-statehood amendments. The county has maliciously stepped outside the scope of its authority by imposing an encumbrance in the form of a water assessment. Edward Kapoi Inn Waimānalo
