1997: Challenging Start
After four years of windfall ineome, of $391 million, where
WHO HAS BENEFITTED? OHA HAS NO PLAN FOR SOVEREIGNTY, BECAUSE OHA HAS FAILED AS A FACILITATOR FOR ALL GROUPS FOR THE PAST 16 YEARS. HSEC IS NOT THE PEOPLE'S WAY. REDRESS FROM CONGRESS IS HIGHLY UNLIKELY DESPITE THE APOLOGY RESOLUTION, OHA HAS PURSUED NO PROGRAM ALU LIKE, $7 MILLION YEAR, PAPA OLA LOKAHI, $4 MILLION A YEAR, $1 MILLION NATIVE HAWAIIAN REVOLVING LOAN FUND MAY PHASE OUT. (SENATOR) INOUYE LOOKS TO OHA. WE ALSO RECETVE $8 MILLION FOR SPECIAL EDUCATION S1 MILLION FOR NĀ PUA NO'EAU, $1 MILLION FOR PUNANA LEO (Clayton) HEE'S PLAN OF EXTRACTING MORE FUNDING FROM THE AIRLINES WILL BE LOCKED IN COURT FOR THE NEXT 16 YEARS, ADD THE ATTORNEY'S FEES WE INCUR. OHA'S ADMINISTRATION RAISED OUR BUDGET BY $62 MILLION. OUR ONLY GUARANTEED INCOME IS $6-8 MILLION IN TRUST FUNDS. WE WILL SPEND MORE THAN WE CAN ANTICIPATE IN THE NEXT 12 YEARS. DID YOU KNOW THIS? TRUSTEES MUST FURNISH INFORMATION TO BENEFICIARIES. WE HOUSE INFORMATION THAT WE MUST MAKE AVAILABLE TO YOU IN 10 DAYS. OURS IS TO MAKE THE TRUST PRODUCTĪVE, TO BALANCE SPENDING WITH INCOME GENERATION. TRUSTEES ARE ACCOUNT ABLE FOR an annual report for EACH fiscal year presented 10 days prior to the next legislature. Beneficiaries must receive: Program performance reports that assess effectiveness in attaining objectives. Program Costs, Long Range Financial Plans AND EVALUATIONS. For misapplication of funds and resources in breach of Fiduciary duties, board members ean be SUED. Chief Justice William Richardson encouraged the Hawaiians to seek restitution through the Courts....We ean aIso use the courts to demand accountability from our TRUSTEES
AND ADMINISTRATORS OF OHA. OHA must deal impartially with beneficiaries, and not favor HSEC over other beneficiary groups. TRUSTEES CANNOT ACT FOR OUR OWN BENEF1T WITHOUT INFORMING OF BENEFICIARIES WHO MAY VOID THE ACTION. TRUSTEES MUST PROVIDE TIMELY INFORMATION REGARDING FINANCIAL ACCOUNTABILITY, PROGRAMS AND E V ALU ATION S TRUSTEES CAN BE MORE INTERESTED IN THE PECKING ORDER TO WIELD THE GAVEL THAN IN SERVING THE BENEFICIARIES. TRUSTEE SERVICE AND LEADERSHIP MUST BE TASK ORIENTED. THE COMMITMENT TO THE "PUBLIC TRUST DOCTRINE"... MIGHT WELL BE OUR AFFIRMATION FOR THE NEW YEAR: Expand and join our eommon heritage. Hold ourselves to an unusually high standard of ethical or moral conduct." To protect the trust from invasion. * * * To advocate the liquidation of our trust to a corporation is a breach of our trust responsibility. * * * (Senator Daniel) INOUYE QUOTES "OHA or DLNR ARE NOT MENTIONED in Washington both have very poor records of accountability." "OHA should not become an alii trust type corporation." "OHA has failed as a facilitator, should have been encouraging and helping to fund all Hawaiian groups to submit sovereignty input. " "OHA should have been busy bringing Hawaiians together." "Stop alienating non-Hawaiians who will make the final decision." "OHA has no business keeping $275 million in a portfoho when Hawaiians need help. " "DHHL should pursue eoheehon of $600 million settlement and not rely on OHA's $40 million in housing support or to piek up payment for lessee defaults.
1997 CRUCIAL ISSUES 1. The Federal Funding of Alu Like and Papa Ola Lōkahi dependent on federal PORK BARREL funding, now in jeopardy. a. No alternate funding was sought by the groups. Inouye says OHA may have to piek up the funding, but is this possible? b. Will OHA have sufficient funds?
e. Why is OHA funding programs for the Alii trusts like KSBE when they are mueh wealthier than we? d. Why does OHA fund a $10 million scholarship program primarily for KSBE graduates, when KSBE has billions of its own funds. WE HAVE MUCH TODOIN 1997 TO PUT OUR HOUSE IN ORDER AND TO UNDERSTAND EACH OTHER AS REGIONAL HAWAIIANS AND ENJOIN OUR COMMON HAWAIIAN SOUL. I
